This article was accepted into the IEEE's 45th Symposium on Security and Privacy and the Canadian Government's ACL Workshop on Online Abuse and Harms. So, there is a real chance that this document will influence policy going forward.
Its conclusion is that traffic to the forum has halved as the result of deplatforming, and that growth has stalled due to a lack of accessibility to normal users. What it says is that deplatforming at an ISP level is generally effective.

There now exists a completely unrelated networking issue with the backend server which is why the site seems so intermittent. From what I see, Tor is working better, and I don't quite know why.

The database randomly decided to shut down about an hour ago and has been flushing pages since. There's about 138,000 left and it flushes about 100 a second. I've never seen this before; if you know what would cause this send an email.

I have identified that unattended-upgrades felt it was very, very important that MySQL be upgraded immediately for some reason so I will trust its judgement. The server is undergoing a normal, healthy reboot.

Comcast customers have reported that Comcast DNS is hijacking kiwifarms.net domain resolution and redirecting them to 104.225.12.42.
If you are experiencing this error, either change your settings, complain to Comcast, or change your DNS to either https://1.1.1.1 or https://dns.google or any other DNS from https://www.privacytools.io/encrypted-dns. -
Russell Greer has been suing me personally and "Kiwi Farms, a website" since 2019. He lost his lawsuit in 2021, and appealed it pro se. Today, his loss was overturned.
After he appealed, a copyright troll organization named the "The Digital Justice Foundation" which takes on every anti-free speech copyright case they can find started representing Greer pro bono. I believe this organization is bankrolled by huge IP holders to accomplish case law in the favor of multinational media companies.
Their defense resulted in an overturning of the summary judgement in a bizarre court opinion referencing recent news about us. This decision will haunt fair use cases moving forward, especially considering Greer has never identified where the infringing file is hosted on the forum.

The courts of Australia have determined that a person I know is personally liable for over $400,000 in defamatory damages to Liz Fong-Jones.
Vincent is Australian. He owns a company called Flow Chemical Pty Ltd in Australia. The Australian RIR, APNIC, leases him a few IP addresses. Those IPs have been used by my American company 1776 Solutions, LLC to host various web services. Among those services has, at various times, been the Kiwi Farms, a website of Lolcow, LLC in the US. Kiwi Farms hosts comments from users all over the world.
Victoria courts have determined that both his company and _him as a person_ are liable for close to half a million dollars in damages for statements made by anonymous users on a web forum owned by a company hosted by a company leasing IP space from his company, regardless of their truth or accuracy. This judgement was made in default in his absence because apparently he felt the entire thing was stupid and would be thrown out without him doing anything.
This loss amounts to nothing for me. I have not been able to reliably use these IP addresses in over a year because Liz Fong-Jones has been harassing any ISP they route through. I also have no stake in Flow Chemical Pty Ltd, so I am not at risk. I can just get new ones at any time in the US.
However, this is obviously unbelievably fucking retarded and evil. I'm not going to let a gross tranny fuck over good people. I am looking for references to attorneys in Australia who would be willing to help overturn this absolute travesty. <jcmoon@pm.me>

I have confirmed that Mullvad's DNS appears to be deliberately failing to resolve <kiwifarms.net>. Mullvad users experiencing this problem may report it through the system tray icon under Settings > Support > Report a Problem. <kiwifarms.st> unaffected.

If you experience an "OpenResty" page, just Ctrl+F5. OpenResty is just the name of a webserver and is not hostile in any way. It showed up for about an hour on clearnet because I misconfigured something.

Polish companies have been the predominant source of our recent uptime. However, Cogent's CEO seems directly invested in shutting us down. I have had multiple run ins with Cogent and this is their most aggressive.
Usually the Tier 1 ISPs have censored the Kiwi Farms by simply refusing to broadcast my IP addresses. However, since Liz Fong-Jones has been successful in censoring the Internet this way, I no longer even try using my IPs.
This time, Cogent has directly instructed a customer of theirs to stop providing us - by name, through the customer's own IP addresses - networking infrastructure.
No company has done this until now. This is the most invasive, direct actioning from any ISP thus far.
If you are in the industry you need to make it absolutely clear to Cogent that you intend to move your business elsewhere. -
Just to confirm, Cogent's CEO is directly forcing two customers to drop us, not just one.

It appears Cogent is blocking connections to the Kiwi Farms. Tier 1 Censorship is in full swing.
You can use Tor-over-Clearnet (i.e. boot the browser and directly pop in kiwifarms.net) for access without paying for a VPN.

My counsel in the Greer case is now Matthew Hardin, who I have worked with previously.
He has filed on my behalf petition for en banc review. We believe the three-judge panel has made serious errors and request a review from the entire 10th District Court.
In short, the mistakes made are:
1) Misapplication of direct copyright infringement tests in a contributory copyright infringement case.
2) Direct contradiction of U.S. Supreme Court case law concerning text links as copyright infringement, which in turn creates sweeping contributory copyright infringement liability for every public platform hosted in the United States, by establishing a new precedent where any link posted on a platform is immediately the responsibility of the platform and its owner as a person.
3) Procedural error denying us the ability to raise fair use as an absolute defense, during a stage in the proceedings where evidence is not submitted, which would be required to raise fair use as a defense.
The 10th Circuit tends to grant en banc review about 3% of the time, however the mistakes made in this published opinion are so severe they jeopardize the established order of fair use across the country, in direct contradiction to existing USSC case law.

The Court has asked for Greer's counsel to respond. Opposing counsel is prohibited from responding to en banc petitions unless the court asks for a response, and the court does not ask for a response unless it generally has decided to accept the petition.
